Federal judge denies xAI's motion to dismiss the NAACP's Clean Air Act suit over the Colossus turbines

What happened

TechCrunch reported that a federal judge denied a motion by xAI to dismiss an NAACP lawsuit accusing the SpaceX-owned company of failing to obtain permits needed to operate the gas turbines powering its Colossus data center outside Memphis — xAI had argued the turbines are exempt from permitting because they are mobile and that the plaintiffs lacked standing; Judge Debra M. Brown wrote that the plaintiffs have statutory standing and that the combustion turbines are not "mobile sources" under Mississippi's State Implementation Plan. TechCrunch adds that a similar motion from the Department of Justice was denied earlier in the month and that it had asked SpaceX for comment. (TechCrunch) Claims: kat-claim-6171b1186d03
TechCrunch reported that the Southern Environmental Law Center, suing on behalf of the NAACP, said xAI had "installed and operated at least 35 combustion turbines and other sources of air pollution at the Colossus site without ever obtaining the necessary preconstruction or operating air permits" — The suit also accuses xAI of violating the Clean Air Act. Credibility ratings combine two public datasets: Lin et al. 2023, PNAS Nexus 2(9):pgad286 (CC BY 4.0) for the domain-quality score, and Wikipedia's perennial-sources list (CC BY-SA 4.0) for the reliability tier. A rating describes an outlet's general record, never this particular article. Unrated means absent from those datasets — not a judgement.
